1. General Disclaimer

The information, software, and services provided by ZCut — including ZCut Creator Studio (Windows) and ZCut Album (Android) — are provided on an "as is" and "as available" basis. ZCut makes no representations or warranties of any kind, express or implied, as to the operation of the Software or the information, content, or materials included therein.

Your use of ZCut Creator Studio and ZCut Album is entirely at your own risk. ZCut shall not be liable for any damages arising from the use or inability to use the Software.

2. No Warranty on Software Functionality

While we strive to ensure that ZCut Creator Studio and ZCut Album function as described, we do not warrant that:

  • The Software will be free of bugs, errors, or interruptions
  • The Software will be compatible with all versions of Windows or Android devices
  • The .zalbum format will remain backward-compatible across all future software versions
  • Exported ZIP files will meet the specific technical requirements of any third-party service (e.g., album printing labs)
  • Watermarks will render identically across all photo types, resolutions, or aspect ratios

3. Photographer's Responsibility

ZCut Creator Studio is a tool provided to assist photographers in their workflow. The photographer using the Software is solely and fully responsible for:

  • The content, quality, and appropriateness of all photographs processed through the Software
  • Obtaining all necessary consents, model releases, and legal permissions for their photography
  • The accuracy of watermark text, studio name, and branding applied to photos
  • Ensuring the .zalbum files they share with clients are accurate and complete
  • Maintaining backups of all original photographs and project files
  • Any contractual obligations between the photographer and their clients regarding photo delivery timelines and selections

ZCut is a facilitating tool only. Any dispute between a photographer and their client regarding photo selections, deliverables, or creative output is entirely outside ZCut's responsibility.

4. Client (ZCut Album User) Responsibility

Clients using ZCut Album to browse and select photos are responsible for:

  • Accurately marking their photo selections before returning the .zalbum file to the photographer
  • Ensuring the .zalbum file is returned to the correct photographer via a secure channel of their choice
  • Understanding that watermarked photos viewed in ZCut Album are previews only — full-resolution originals are delivered separately by the photographer upon confirmation

5. Security Disclaimer

The .zalbum format is a proprietary encrypted container designed to prevent the files from being opened in any software other than ZCut Album. While this provides a meaningful layer of protection:

  • ZCut does not guarantee that the .zalbum format is completely impervious to unauthorized access under all circumstances
  • Photographers should exercise reasonable care when transferring .zalbum files, particularly over public or unsecured networks
  • ZCut is not responsible for any unauthorized access to photos that occurs due to circumstances outside the Software itself (e.g., device theft, account compromise of a sharing platform)

The watermark feature is an additional deterrent against unauthorized use of preview images. It does not constitute a legally enforceable copyright mechanism on its own. Photographers retain copyright in their photographs regardless of the presence or absence of a watermark.

6. Third-Party Services and Advertising

ZCut Album displays advertisements served by Google AdMob and potentially other advertising networks. ZCut:

  • Does not endorse, verify, or take responsibility for any products or services advertised within the app
  • Is not affiliated with any advertisers whose ads appear in ZCut Album
  • Is not responsible for the privacy practices of third-party advertising networks

Links or references to external websites or services within our app or website are provided for convenience only and do not constitute an endorsement.

7. Data and File Loss

ZCut Creator Studio and ZCut Album are local, offline tools. ZCut is not responsible for any loss of data, photographs, project files, or .zalbum files that may result from:

  • Hardware failure, device damage, or loss
  • Software errors, crashes, or incompatibilities
  • Accidental deletion by the user
  • Operating system updates that affect software compatibility
  • File corruption during transfer between devices

We strongly recommend that photographers maintain independent backups of all original photo files at all times.

8. "Free" Nature of the Software

ZCut Creator Studio and ZCut Album are currently offered free of charge. This free status may change in the future. ZCut reserves the right to introduce paid features, a subscription model, or to discontinue the free tier at any time, with or without prior notice. Continued use after such changes constitutes acceptance of the new terms.

9. Changes to This Disclaimer

ZCut reserves the right to modify this Disclaimer at any time. Changes will be posted on this page. Continued use of the Software after changes are posted constitutes your acceptance of the updated Disclaimer.
